We are a company specializing in the sale of furniture and interior decoration, selling our items in our showroom and remotely via the Internet or by telephone.
1. Object
These General Conditions are presented to define the terms of sale between Mançana - Mobiliário, Lda, with Tax Identification Number 502331780, hereinafter referred to as Mançana - Home and Contract, and its clients defined below. Any individual or legal entity that places an order on the website www.mancana.com, whether a private client or not, becomes a client under these General Conditions.
1.1 Scope of Application
These General Terms and Conditions of Sale govern the sale of products from the website www.mancana.com. These terms and conditions apply whether the order was placed via the Internet, email, or telephone.
1.2 Customer Acceptance
The customer's act of validating their order automatically implies express acceptance of these General Terms and Conditions of Sale. These conditions apply to the exclusion of all other conditions, unless otherwise agreed in writing by both parties. Purchases made by email, telephone, or mail also imply acceptance of these terms and conditions. They can be read directly on our website. They can also be sent by email, fax, or mail at the customer's request.

Mançana - Home and Contract strives to provide, whenever possible, the user manual in the consumer's language. Unfortunately, there are situations in which it may not be provided in paper form, being only available in digital format or downloadable directly from the Internet.
1.6 Prices
1.6.1 The sales prices indicated on the website are in euros.
The prices for mainland Portugal and the islands appear when added to the cart after registering on the website, including shipping costs to ground floor level, but excluding assembly. If you require heavy products that need to be delivered by 2 people and carried to upper levels and assembled, you must request a quote. Shipping costs to other European countries and the rest of the world must be requested by email and will be provided via quotation.
1.6.2 All prices indicated are correct except for data entry errors.
If an order is placed for an item whose price is incorrect, we reserve the right to cancel the order and refund the customer the amount paid.
2. Value Added Tax (VAT)
2.1 Application
VAT applies to sales concluded with residents of the European Union. It does not apply to non-Portuguese companies in the European Union that have an intra-community VAT number.
VAT does not apply to export sales (countries outside the European Union).

3. Order
3.1 Order Processing

Any customer may cancel their order at any time, unless the cancellation causes any kind of loss to Mançana - Home and Contract. In this case, if the customer does not actually want the ordered products, they must accept payment of all expenses incurred up to the moment of order cancellation and, if the order has already been delivered, must return it at their own expense (see Returns), i.e., return it unopened, mentioning "order refused". Returns of display products purchased with a promotional discount are not accepted for this reason.
3.4 Product Availability
Our product offers and prices are valid while they are visible on our website and subject to stock availability. More detailed information may be provided by phone, fax or email. If Mançana cannot obtain a product from suppliers within the stated timeframe, the customer will be informed of the order status via email. Therefore, the customer should not make payment without first having our confirmation of the delivery time.
4. Payment
Mançana - Home and Contract, in addition to full payment upon ordering, offers the option for the customer to pay 50% upon ordering and the remaining amount before delivery. In case of partial shipment of an order, only the value of the goods shipped will be charged. Mançana - Home and Contract reserves the right to refuse an order.

Mançana - Home and Contract reserves the right to refuse to make a delivery or fulfill an order from a customer who has not paid in full. All payments must be made before delivery.

Bounced checks and all types of abusive falsification of checks or cards will be subject to immediate legal action.
4.4 Retention of Title:
Mançana retains ownership of the products until payment is received from the customer. If you are a customer with a current account at Mançana - Home and Contract, payment must be made according to previously agreed conditions. Valid for Professional Clients.
5. Invoice, Cash Sale
The online order confirmation issued by the customer does not serve as an invoice. Regardless of the order type and payment method, the customer will only receive the invoice after delivery.
6. Deadlines
6.1 Order Processing Times:
Orders placed online are processed in order of arrival from Monday to Sunday. The processing time for an order varies depending on the time indicated with each product.
6.2 Shipping Times:
Shipping times are indicated by Mançana or the carrier. These are provided to the customer as an estimate, in working days, and also depend on the accuracy of the address provided by the customer on the order date, as well as their availability to receive the order. The failure of the carrier to meet these deadlines cannot, under any circumstances, compromise Mançana's responsibility. These deadlines are indicated to the customer at the time of shipment.
7. Shipping
We only deliver from Monday to Friday, and we always give at least 24 hours' notice.
7.1 Packaging
The products to be shipped are packaged and prepared to arrive at the delivery location in perfect condition, always taking customer satisfaction into consideration.
7.2 Confirmation
If the customer placed their order on the website, an automatic order confirmation email will be sent. The order should only be paid after our confirmation of the delivery deadline and will only be processed after confirmation of the down payment. If the email does not reach the customer for technical reasons, they should contact Mançana by phone.
7.3 Shipment Tracking
Whenever the merchandise is shipped via the carrier, we provide the carrier's name and contact information. Order tracking depends on the carrier and is their responsibility. Mançana is not responsible for schedules, errors, or setbacks that may occur to the carrier and that may limit the possibility of delivering the order as agreed.
7.4 Shipping Costs
To obtain the shipping cost for the desired product(s), add the product to your shopping cart and enter the country and postal code of the delivery location. You will then receive an accurate shipping cost, if applicable. This calculation is based on weight-volume and location rules provided by the delivery carrier, or on the order value, as shipping is free above a certain amount. Customers can always choose to pick up their order at our facilities without any associated shipping costs.
Shipping costs are only applicable to mainland Portugal and the islands, and are for ground floor level deliveries, excluding assembly. For heavy items requiring two people to carry them to higher levels and assemble them, please request a quote. Shipping costs to other European countries and the rest of the world should be requested via email.
8. Delivery
8.1 Delivery Location
Orders are delivered to the delivery address indicated by the customer on the order form, but only at ground floor level. Prices do not include transport to upper floors or assembly unless agreed upon by both parties.
8.2 Absence on Delivery Day
You will be informed of the estimated delivery date of your order. You must indicate a delivery address where someone is always present between 8 am and 9 pm. In the case of delivery by courier, if the delivery is not completed, you will be informed of the date and time the courier was present, and a new delivery attempt will be made on a day to be agreed upon with them. If the delivery is made by Mançana, it must be made on the agreed date, otherwise it will be held for an indefinite period until we organize another shipment for the region.
8.3 Delivery Times
The estimated delivery time is indicated next to each product.
8.4 Loss of Orders by Carriers
In this case, Mançana - Home and Contract is obliged to respect the deadlines imposed by the carrier regarding the declaration of loss and the reimbursement of the shipment. Therefore, the customer must also wait for these deadlines: - Consequently, you have a maximum of 30 working days from the receipt of the order shipment confirmation email to declare it lost to Mançana - Home and Contract. Beyond this period, no claim will be accepted. On the other hand, if the customer declares the loss of the order within the established deadline, Mançana will have to open the claim process. In this case, Mançana may request the necessary documents from the customer to open the claim process. The customer must provide the requested data as quickly as possible. Finally, definitive answers regarding inquiries are given by the carrier within a period ranging from 1 to 3 weeks. There can be two types of situations: either the order is recovered and reshipped to the customer according to normal procedures, or the order is declared lost by the carrier and Mançana informs the customer to arrange a second shipment of the order or will be refunded the invoiced amount, according to the customer's preference.
8.5 Receiving the order
We recommend that all orders delivered by Mançana - Home and Contract be checked and inspected, and that the customer make any necessary notes about the condition of the product on the carrier's freight bill in case of partial or total deterioration. If the delivery is made by Mançana, this should be pointed out to our staff who were carrying out the delivery. Without the customer's proper notes, the order cannot be subject to subsequent dispute with Mançana. Verification of the product's condition is considered complete once the freight bill is signed.
8.5.1 If the product is damaged, please photograph it and send the photo to geral@mancana.com within a maximum of 24 hours so that we can activate the transport insurance.
8.5.2 Any package received at our facilities without sender identification or sent collect on delivery will not be accepted.
8.6 Order content error
Upon receiving the order, the customer must notify Mançana by phone, fax, or email of any non-conformity of the products in type, quality, or quantity compared to the order details.
The non-conformity claim must be made within a maximum of 24 hours after delivery of the order. Claims not made in accordance with the rules defined above and within the indicated deadlines will not be accepted by Mançana.
8.7 Strikes or force majeure events
In the event of a carrier strike or other exceptional event that delays or prevents delivery of the order, Mançana will inform the customer of the delivery status.
8.8 Export Control and Local Legislation
You must inquire with the local authorities in your area of residence about the conditions for importing ordered products and must make all corresponding declarations and/or payments to the competent bodies of the countries concerned. 9.1.2 Packaging Condition
Returned items must be in perfect condition, complete, and properly packaged in their original packaging and without any signs of actual use. In case of withdrawal or error on the part of the customer, the shipping and return costs will be the sole responsibility of the customer.
9.1.3 Internal Error
Mançana - Home and Contract is responsible for return and reshipment shipping costs if there is an internal error and the product sent does not match the order. If you wish to exchange it for a different item, the return and new shipping costs will be the customer's responsibility.
9.1.4 Original Defects

Important Note: We recommend that you pay attention to the external condition of the packaging, as it may reflect possible damage to the product. Upon delivery and in the presence of the delivery person, you must check the condition of the product before signing the Shipping Guide and thus accepting the order. If the product is damaged, please photograph it and send the photograph to geral@mancana.com within a maximum of 24 hours so that we can activate the transport insurance.

10.5 The login information will be exclusively known to you, and mancana.com undertakes not to disclose this code under any circumstances. Given the nature of login information, mancana.com cannot be held responsible for the misuse of it by its clients.
