1. Identification

Mançana commercializes furniture, sofas, decoration items, and related products through its online store, showroom, email, and telephone.

Placing an order implies the full acceptance of these General Conditions of Sale.

 

2. Availability and Products

The products presented on the website are subject to stock availability, confirmation from suppliers, or production upon order.

Mançana reserves the right to inform the customer, after the order has been placed, about any eventual stock unavailability, changes in delivery times, technical modifications, or impossibility of supply.

Important Recommendation:

Payment for the order should only be made after confirmation from Mançana regarding product availability and the estimated delivery timeframe.

Product images are merely illustrative. There may be variations in color, texture, finish, shade, or dimensions, especially in natural materials, fabrics, leathers, woods, stones, ceramics, and other materials subject to variations inherent to their manufacturing process.

Due to the nature of the commercialized products, they may be:

  • Produced upon order;

  • Customized in dimensions, materials, colors, or finishes;

  • Ordered from suppliers specifically to satisfy the customer's order.

When a product is produced, customized, or ordered specifically for the customer, it is considered that Mançana has initiated a production, procurement, or commercial brokerage process intended exclusively for that order.

In these cases, and under the terms of the applicable legislation, namely Article 17 of Decree-Law no. 24/2014, it is not possible to cancel the order after production has started or after the order has been placed with the supplier. Furthermore, no returns or refund requests will be accepted, except in cases of manufacturing defects or legally proven non-conformity.

 

3. Prices

All prices displayed include VAT at the legal rate in force, unless otherwise stated.

Unless expressly mentioned, prices do not include shipping costs, assembly, installation, delivery to upper floors, special services, or other additional services.

Mançana reserves the right to alter prices, campaigns, promotions, or commercial conditions without prior notice, without prejudice to orders that have already been confirmed.

 

4. Orders and Payments

The validation of an order may require:

  • Full payment in advance; or

  • Partial payment as a deposit, with the remaining balance being settled prior to the dispatch or delivery of the products.

The order will only be considered valid upon confirmation of payment or the agreed deposit.

Available payment methods:

  • Multibanco (Portuguese Interbank Network);

  • MB Way;

  • Bank Transfer;

  • Visa, Mastercard, or American Express credit/debit cards.

Payment options:

  • 100% at the time of the order; or

  • 50% upon confirmation (deposit) + 50% prior to dispatch or delivery.

When there is a remaining balance to be paid, it must be fully settled before the products are loaded, dispatched, or delivered.

Mançana reserves the right to refuse orders, namely in the event of an obvious error, stock unavailability, suspicion of fraud, prior default, impossibility of supply, or lack of payment confirmation.

 

5. Delivery Times

The indicated delivery times are merely estimates and may vary depending on production, supplier availability, transport, logistics, holiday seasons, strikes, customs, force majeure, or other external circumstances.

Mançana undertakes to inform the customer whenever there are relevant changes to the initially estimated timeframes.

Delays in delivery, when not directly attributable to Mançana, do not automatically grant the right to cancel the order, or claim compensation or a refund, especially when dealing with customized products, products made-to-order, or items ordered specifically from suppliers.

 

6. Delivery, Transport, and Shipping Fees

To find out the shipping costs for Mainland Portugal, the customer must register on the website and add the desired items to the shopping cart. The shipping fee will be displayed automatically, always assuming a ground-floor (rés-do-chão) delivery.

For deliveries requiring assembly, carrying items to upper floors, special equipment, transport requiring two or more people, a crane, an elevator platform, or other additional services, a prior quote must be requested.

For deliveries to Madeira, Azores, Europe, Africa, or the rest of the world, a prior quote must be requested.

The customer may also choose to pick up the goods directly from Mançana's facilities, free of any transport costs.

Deliveries are carried out via transport carriers or through the company's own logistics.

Unless expressly stated otherwise:

  • Delivery is made at ground-floor level;

  • It does not include assembly, installation, or removal of packaging;

  • It does not include carrying items up stairs, elevators, or via special access routes.

The customer is responsible for ensuring:

  • A correct and complete delivery address;

  • A valid telephone contact number;

  • Availability to receive the goods;

  • Adequate access conditions;

  • Sufficient space for the passage and placement of the products.

If delivery is not possible due to factors attributable to the customer, additional costs for a new delivery attempt, storage, or transport may be charged.

 

7. Verification at the Time of Delivery

Upon receipt, the customer must verify the external condition of the packaging and, whenever possible, the condition of the products.

If there is visible damage, the customer must:

  • Expressly note the damage on the carrier's delivery note (guia de transporte);

  • Take photographs of the packaging and the product;

  • Report the situation to Mançana within a maximum period of 24 hours following delivery.

Claims for transport damage must be accompanied by photographic evidence. The absence of a note on the carrier's delivery slip or a communication made outside the deadline may hinder or invalidate the activation of the transport insurance.

 

8. Right of Withdrawal (Cooling-off Period) and Returns

Under current legislation, consumers have 14 days to exercise their right of withdrawal without giving a reason, except for the exceptions provided by law.

For a return to be accepted, the product must be:

  • In perfect condition;

  • Without signs of use, improper assembly, or damage;

  • In its original packaging;

  • Complete, with all accessories and documentation.

The customer is responsible for the return shipping costs, except in cases of an error attributable to Mançana or a legally proven defect/non-conformity.

The following are excluded from the right of withdrawal, pursuant to Article 17 of Decree-Law no. 24/2014:

  • Customized products;

  • Made-to-order products;

  • Products manufactured according to customer specifications;

  • Products ordered from suppliers specifically for the customer;

  • Exhibition items, clearance sales, or promotions with an express indication of exclusion;

  • Products which, by their nature, cannot be returned after being opened, used, assembled, or handled.

When a product is ordered from a supplier specifically to fulfill a customer's order, Mançana is operating within a commercial transaction intended exclusively for that specific order and does not necessarily keep the item in its regular stock.

In these cases, once the order, payment, and production or procurement from the supplier have been confirmed, cancellation, return, or refund is not possible, except in legally provided cases of manufacturing defect or non-conformity.

 

9. Professional Purchases — B2B

When a purchase is made within the scope of a professional activity—namely by a company, architect, designer, decorator, project studio, hotel, business, restaurant, or any other professional client—it is considered a B2B (Business-to-Business) relationship.

Indications of a professional purchase include, among others:

  • An order placed by a company or professional entity;

  • An invoice issued with a corporate/business tax ID (NIF);

  • The use of the product in a commercial activity or professional project;

  • A purchase intended for resale, construction works, hospitality, offices, stores, or commercial spaces;

  • The intervention of an architect, designer, decorator, or other professional.

In B2B relationships, the legal regime for consumer protection does not apply, nor does the 14-day right of withdrawal provided for in Decree-Law no. 24/2014.

B2B sales are governed by the Portuguese Civil Code, namely by the articles relating to purchase and sale contracts, the principle of freedom of contract, and the principle of the binding force of contracts (pacta sunt servanda).

Therefore, in professional purchases:

  • There is no automatic 14-day right of return;

  • There is no unilateral cancellation of the order;

  • There is no obligation to issue a refund once the order is confirmed;

  • The contract must be strictly fulfilled by both parties.

Mançana may refuse cancellations that entail financial loss, costs with suppliers, the start of production, the acquisition of materials, or an order placed with a supplier.

Mançana may, as a matter of commercial courtesy, analyze alternative solutions, provided they do not cause financial prejudice to the company. Such analysis does not constitute any admission of a legal obligation.

 

10. Refunds

Whenever a refund is applicable, it will be issued within a maximum period of 14 days following the receipt and verification of the returned product.

The refund will be processed using the same payment method used for the initial purchase, unless expressly agreed otherwise.

Mançana reserves the right to withhold the refund until the goods have been received or until proof of shipment of the goods has been provided, in accordance with applicable legal terms.

Additional costs resulting from special delivery options, assembly, express transport, delivery to upper floors, or other additional services that have already been rendered will not be refunded.

 

11. Warranty

All products benefit from the applicable legal warranty of conformity, in accordance with current Portuguese legislation.

In the event of a defect or non-conformity, the customer must contact Mançana, describing the situation and attaching photographs or other elements that allow for an assessment of the problem.

The warranty does not cover damage resulting from:

  • Improper use;

  • Incorrect assembly;

  • Poor maintenance/care;

  • Modifications made by the customer or third parties;

  • Normal wear and tear;

  • Damage caused during transport arranged by the customer;

  • Inadequate exposure to heat, humidity, sunlight, chemical products, or external agents.

12. Liability

Mançana cannot be held responsible for delays, damage, or non-compliance resulting from factors beyond its control, namely:

  • Transport carriers;

  • Suppliers;

  • Strikes;

  • Customs delays;

  • Natural disasters;

  • Wars, pandemics, or legal restrictions;

  • Power, communication, or computer system failures;

  • Situations of force majeure.

Mançana undertakes, however, to assist the customer and seek reasonable solutions whenever possible.

 

13. Privacy and Security

Mançana uses the personal data collected through the website for order processing, invoicing, delivery, customer support, and potential promotional communications regarding its products and services, in accordance with the applicable legislation on personal data protection.

Mançana does not sell, trade, or rent its customers' personal data to third parties.

The customer can access their Customer Area to view, enter, or update their personal data.

To exercise rights of access, rectification, objection, erasure, or other rights provided for in the applicable legislation, the customer must contact Mançana through the means provided on the website.

The customer undertakes to provide true, complete, and updated information at the time of registration or order placement.

The username and password are personal and non-transferable. The customer is responsible for their proper use and for the confidentiality of their access data.

Mançana cannot be held liable for the improper use of access data by the customer or by third parties to whom the customer has provided such data.

 

14. Intellectual Property

All content present on the website www.mancana.com—including texts, images, photographs, videos, designs, graphics, logos, trademarks, domains, graphic design, and other elements—belongs to Mançana or to third parties who have authorized its use.

The copying, reproduction, alteration, distribution, sale, dissemination, or commercial use of the website's content without prior and express authorization from Mançana is strictly prohibited.

Any unauthorized use may constitute a violation of intellectual property rights and give rise to civil and/or criminal liability.

 

15. Product Information

Mançana does not distribute paper catalogs.

The photographs, descriptions, dimensions, and technical information presented on the website are provided with the greatest possible accuracy, but they may contain minor variations, typographical errors, or changes made by manufacturers or suppliers.

Mançana reserves the right to correct, update, or alter product information at any time.

 

16. Amendment of Terms and Conditions

Mançana reserves the right to adapt, alter, or update these Terms and Conditions at any time.

Amendments will take effect immediately upon publication on the website, without prejudice to orders that have already been previously confirmed.

 

17. Disputes and Governing Jurisdiction

In the event of a dispute, and without prejudice to mandatory legal rules applicable to consumers, the court of the Judicial District of Paredes (Comarca de Paredes) shall have exclusive jurisdiction, with express waiver of any other.
